THE PURCHASE of a home with a mortgage loan involves not only a substantial financial investment, but two legal transactions that require an understanding of both federal and state law. It is important to be represented by an attorney knowledgeable about the law with whom you can feel comfortable.
When I represent you as the BUYER of residential property, I will:
- advise you about the terms of your contract and the local customs that affect residential transfers
- assist you in finding answers to any questions you may have concerning contract contingencies
- review the mortgage commitment and advise you of any issues that may arise from it
- arrange for a title search and obtain such title insurance policies as may be required or requested
- coordinate the closing with you, your mortgage lender, and the seller’s attorney
- review the mortgage documents and advise you of any issues that may arise from them
- work with the lender to satisfy any other closing requirements arrange to obtain payoff figure(s) and release(s) of your current mortgage(s) on the property
- prepare the closing statement and the adjustments with the seller’s attorney and lender
- review all figures with you prior to closing
- attend the closing as your representative
- review all of the seller’s documents
- record on the land records all appropriate documents as soon as possible after the closing
When I represent you as the SELLER of residential property, I will:
- advise you about the terms of your contract and the local customs that affect residential transfers
- contact the buyers’ attorney and advise him/her of any encumbrances on the property, such as mortgages or other liens of which you are aware
- discuss the results of the title work provided by the buyer’s attorney to ensure that there are no other liens or other encumbrances which must be released before the closing can occur
- arrange to obtain a payoff figure and release(s) of your current mortgage(s) on the property
- prepare the closing statement and adjustments with the buyers’ attorney, and review them with you
- prepare the deed on your behalf as well as other instruments affecting conveyance or your title and review these with the buyers’ attorney
- represent you at the closing and forward the appropriate mortgage payoff checks as soon as possible after the closing
- issue this firm’s clients’ funds check in the amount of the net proceeds of sale payable to you
When I represent you in the REFINANCE of your mortgage loan, I will:
- review the mortgage commitment and advise you of any issues that may arise from it
- arrange for a title search or title update and obtain such title insurance policies as may be required or requested
- coordinate the closing with you and your mortgage lender
- review the mortgage documents and advise you of any issues that may arise from them
- work with the lender to satisfy any other closing requirements
- arrange to obtain payoff figure(s)e and release(s) of your current mortgage(s) on the property
- prepare the closing statement and adjustments with the mortgage lender
- review all figures with you prior to closing
- attend the closing as your representative
- record on the land records all appropriate documents as soon as possible after the closing
